الوصف الوظيفي: The Senior Legal Counsel – Construction & Dispute Resolution will serve as a strategic legal advisor and integral member of the legal team, specializing in the construction industry and dispute resolution processes. This role demands a profound understanding of construction law, contractual negotiations, risk management, and effective dispute resolution mechanisms. The successful candidate will demonstrate a history of managing legal complexities associated with large-scale construction projects and providing proactive legal advice to senior management and project teams. This individual will leverage their extensive experience to lead negotiations, resolve conflicts, and ensure compliance with applicable laws and regulations. Through exceptional stakeholder engagement and strategic thinking, the Senior Legal Counsel will play a critical role in safeguarding the organization's interests and enhancing its operational efficiencies, while promoting a culture of legal and ethical compliance. Job Requirements: A Juris Doctor (JD) degree from an accredited law school and admission to the bar in the jurisdiction of practice. A minimum of 12 years of relevant legal experience, with at least 8 years focused on construction law and dispute resolution. Proven track record of leading complex negotiations and managing multifaceted construction contracts, including general conditions, subcontractor agreements, and change orders. Extensive knowledge of local, state, and federal regulations affecting construction projects, alongside an understanding of international construction law where applicable. Experience in litigation management, preferably in construction-related disputes, with demonstrated ability to devise effective litigation strategies. Skill in advising on risk management practices in construction projects, including identifying potential legal pitfalls and providing mitigative solutions. Strong proficiency in alternative dispute resolution processes, including mediation and arbitration, with a history of successful outcomes in managing disputes without litigation. Excellent communication and presentation skills, with an ability to articulate complex legal concepts to non-legal stakeholders effectively. Demonstrable experience in project management, leading cross-functional teams, and driving deliverables in a fast-paced environment. Commitment to continuing legal education and maintaining an up-to-date understanding of industry changes and developments. Job Responsibilities: Provide expert legal counsel on construction contracts, ensuring alignment with corporate policy and maximizing protection against legal risks. Lead negotiations of contractual terms with clients, subcontractors, and other stakeholders to achieve favorable outcomes and manage expectations. Conduct comprehensive legal reviews of project documentation, including contracts, proposals, and compliance matrices, identifying areas for improvement and risk exposure. Develop and implement strategies for dispute resolution, aiming to resolve conflicts amicably and expediently while preserving business relationships. Oversee and manage litigation processes related to construction disputes, working closely with outside counsel to formulate case strategies and interventions. Provide training and guidance to project teams on legal issues, fostering a culture of compliance and awareness of potential legal ramifications in various project stages. Collaborate with internal departments, including finance, procurement, and risk management, to ensure holistic alignment of legal strategies with business objectives. Monitor changes in legislation and industry standards, providing timely updates to stakeholders and adjusting contract templates and corporate policy as needed. Draft, review, and negotiate a wide range of legal documents and agreements, ensuring all legal obligations are met and liabilities are mitigated. Mentor and develop junior legal staff, offering leadership and enhancing the capability of the legal department. Strong negotiation and conflict resolution skills, with the ability to influence stakeholders and drive consensus. Proficiency in analysis and interpretation of complex legal documents, with meticulous attention to detail.
